Intra Company Transferee-Work permit-Significant Benefit-C12
International companies can temporarily transfer qualified employees to Canada on work permit for the purpose of improving management effectiveness, expanding Canadian exports, and enhancing competitiveness in overseas markets.
It is exempt from labour market impact assessment(LMIA).
Key Requirements
Following are the key requirements for the applicant to qualify for transfer to company in Canada.
Current employment
The applicant is currently employed by a multi-national company and seeking entry to work in a parent, a subsidiary, a branch or an affiliate of that enterprise.
Current Position
The applicant is being transferred to an executive, senior managerial, or specialized knowledge capacity position.
Duration of employment
The applicant being transferred has been employed continuously by the company in a similar full-time position for at least one year in the three years immediately preceding the date of initial application.

Business plan
The company transferring an executive must have a business and staffing plan. How they will finance the company and pay the employees. Market research and support/contracts from potential clients, suppliers and customers will be beneficial.
Qualifying relationship
For intra-company transferee classification, ownership and control are the factors which establish a qualifying parent, branch, subsidiary, or affiliate relationship, Licensing, Franchise, Contracting, Exchange of products and services do not constitute qualifying relationship.
Work permit and renewal
Initially issued for 1 year and can be renewed based on continued qualifying relationship, provision of products or services as per plan and staffing plan.
Pathway to permanent residence
Upon completion of one year, the executive or senior manager can qualify for additional points for Job offer and Canadian experience and they can qualify for express entry.
Intra Company-Specialised Knowledge
Qualifying relationship
The applicant should have employer and employee relationship with the company in Canada and the position should exist with specialised knowledge.
Evidence of specialised knowledge
Specialised knowledge include specific skills and knowledge not available in Canada including advanced proprietary knowledge. Additional factors of NOC, training, experience, education, wages are considered.
Work permit and renewal
Initially the work permit is issued for 1-2 years and can be renewed on the basis of continued requirement. Specialised worker and Functional manager have a Cap of maximum 5 years continuous employment in Canada. After that they need to work outside Canada for one year.
Pathway to permanent residence
Applicants can get points for job offer and Canadian experience after completing one year. Additional points are sufficient enough to qualify for the express entry CRS score if the applicant has a good score in English language test.
